Beginning September 1, 2025, noncompetition agreements with dentists, professional and vocational licensed nurses, and licensed physician assistant (collectively “health care practitioners”) must include:

  • An option to buy-out of the noncompete in an amount not greater than the practitioner’s total annual salary and wages at the time of termination;
  • Temporal limitations not greater than one-year following the termination of employment;
  • Geographic limitations not greater than a five-mile radius from the primary practice locations of the health care practitioner;
  • Be clearly and conspicuously stated in writing.

Agreements that do not include these provisions are likely to be held unenforceable.
